The Ombudsman files ex officio proceedings seeking to clarify how the Pegasus spyware was used

The Ombudsman has filed ex officio proceedings before the Spanish Intelligence Service (CNI) in order to check whether the alleged tapping of communications with Pegasus spyware (being voiced in the media) was carried out in full compliance with all constitutional and legal guarantees.

Ángel Gabilondo has sent notice to the CNI manager of the filing of these ex officio proceedings and has requested certain information on internal protocols affecting the tapping of communications, the court’s prior authorisation and use of the Pegasus spyware.

Furthermore, the Ombudsman considers that an Official Secrets Committee should convene as soon as possible in the Congress of Deputies- which has been unable to convene over the last three years- as a means of regularly checking on the CNI’s activity, pursuant to Article 11 of Act 11/2002, of 6 May.

With this initiative, the Ombudsman is trying to encourage the sound operation of all state institutions and to safeguard fundamental rights recognised in the Spanish Constitution, of general interest to Spain’s citizens.
