The Ombudsman urges the Ministry of Justice to remove a contradiction in the statute of limitations for crimes against the liberty of minors

The Ombudsman, Ángel Gabilondo, has urged the Ministry of Justice to resolve a contradiction in the statute of limitations for crimes against the liberty of minors. This recommendation was made after analysing the documentation submitted in a complaint registered with the Institution last January. The Ombudsman’s technical services have come to the conclusion that there is a contradiction between the second and third paragraphs of Article 132.1 of the Penal Code, with regard to the starting point for the calculation of the limitation periods provided for crimes against the liberty of minors.

The Institution urges that this situation be resolved as soon as possible and that the reform to be made be as favourable as possible to the procedural position of victims and other complainants in criminal proceedings.

The Ombudsman’s recommendation has been forwarded to the Ministry of Justice, which has corresponding powers in matters of criminal law. The person who lodged the complaint with the Institution has also been informed.
