The child protection law incorporates recommendations made by the office of the ombudsman

08-25-2015

The Law modifying the system for protecting children and adolescents that came into force on 18 August incorporates recommendations made by the Office of the Ombudsman in defence of the rights of minors.

  • It reinforces the protection of minors in gender-violence contexts by recognising them as victims, in line with what the Institution had requested.
  • It reforms the pension system to prevent murderers from collecting the widower’s or widow’s pension and allows the offspring of a married couple, one of whom kills the other, to receive the complete orphans’ pension.
  • Priority is given to placing the minors in foster care as opposed to them going into a residential facility.
  • It provides for the fact that the minor must be listened to in any administrative proceedings, whether judicial or mediation related, in which he/she is impacted, as set out in the case studies “La escucha y el interés superior del menor: revisión judicial de medidas de protección y procesos de familia”, and “La escucha del menor, víctima o testigo”.
