BUDGET 2023

The Ombudsman’s budget is included in the General State Budget within the budget of the Parliament, of which he is High Commissioner, under the heading Service 05: Ombudsman, Section 02: Parliament.
The structure of the budget, organised in 5 chapters, is regulated according to the economic classification established by the Ministry of Finance (Resolution of 20 January 2014, of the Directorate General of Budgets, content in Spanish)
Chapter I “Staff expenditure” covers all the remuneration of the authorities and staff serving the institution.
Chapter II ‘Current expenditure on goods and services’ covers appropriations enabling the institution to carry out its activities, i.e. supplies, repairs, maintenance and conservation, etc.
Chapter III “Financial charges” comprises interest from the Bank of Spain.
Chapter IV “Current transfers” is allocated to cover the financial cost of the prizes awarded by the institution, as well as to cover membership fees and participation in international networks
Chapter VI concerns “Real investments”. This chapter includes both new and replacement investment forecasts associated with the operational functioning of the services, such as computer equipment or furniture, as well as expenditure on intangible investments, mainly computer software.

TECHNICAL INFRASTRUCTURE

This section summarises the main infrastructure of the Ombudsman in the field of Information and Communication Technologies (ICT), as well as those others that, in the technical environment, are considered essential for the normal functioning of the institution’s activity.
The Infrastructure area of the General Secretariat is responsible for its administration and management. This area is divided into the IT Service and the Maintenance Service, the purpose of both being to provide staff with the appropriate infrastructures for the performance of their work in accordance with the needs of the institution and its continuous and necessary evolution over time. SUBSIDIES

The Ombudsman has no legal functions that would allow it to establish lines of subsidies or grants.
It organises competitions for awards related to the protection of fundamental rights, which constitute financial transfers of prizes, in cash and commemorative plaques, to non-profit organisations, families and institutions, including foreign ones. INDEMNITIES

Law 3/2015, of 30 March, regulating the exercise of senior positions in the General State Administration, establishes in section 1 of article 6, which deals with Compensation after leaving office, that “those who, in accordance with the applicable regulations, have this right recognised, shall receive monthly financial compensation, for a maximum period of two years and in accordance with the provisions of the following article”. Article 7, entitled Incompatibility of remuneration, is intended to establish the incompatibility of these indemnities or financial compensation with any remuneration charged to the budgets of the Public Administrations, of the bodies, agencies and companies dependent on them, or charged to those of constitutional bodies or resulting from the application of tariffs, as well as with any remuneration deriving from a private activity, with the exception of those provided for in Article 13.2.c) (which are those of mere administration of personal or family assets, artistic, scientific or technical production and creation, or participation in non-profit cultural or charitable organisations), as well as with the receipt of a retirement pension or retirement by passive rights, or by any public and compulsory Social Security scheme.
Pursuant to the provisions of the fifth additional provision, paragraph 1, of Law 21/1986 of 23 December 1986, the Ombudsman was included among the senior officials for whom Article 10.5 of Law 74/1980, of 29 December 1980, provided for the right to receive, as of the month following the month in which he left office, and for a period equal to that in which he had held the post, with no more than twenty-four monthly payments, a monthly compensation pension equal to one twelfth of eighty percent of the total remuneration assigned to the post in the budget in force.
Likewise, the tenth additional provision of Law 14/2000, of 29 December, on fiscal, administrative and social measures, extended this same right to the post of deputy Ombudsman.

EXPENSES AND VEHICLES

In 2012, representation expenses, subsistence allowances and other allowances for reasons of service were abolished for both senior officials and staff of the Institution, maintaining only a budget item to finance the cost of travel, accommodation and meals on official journeys. The State Vehicle Pool has assigned three vehicles to the Ombudsman for official travel and for the incident service.
